Terms of Service
These Terms of Service ("Terms") govern your use of Cherished ("we," "us," "our"), accessible at https://cherished.cc. By using the service or making a purchase, you agree to these Terms.
1. The service
Cherished provides a one-time-payment digital memorial service. For a single payment of $49, you may create one memorial page in honor of a deceased person. The memorial page will be hosted at a unique URL for 100 years from the date of generation.
2. Eligibility
You must be at least 18 years old and able to enter a legally binding agreement to use Cherished. You may only create a memorial page for a person who is deceased.
3. Your content
When you create a memorial page, you provide text, photos, and other media ("Your Content"). You retain ownership of Your Content. By submitting Your Content to Cherished, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and reproduce Your Content for the purpose of operating the service.
You represent that:
- You have the legal right to share Your Content
- Your Content does not infringe anyone else's intellectual property, privacy, or publicity rights
- Your Content does not contain unlawful, defamatory, or harassing material
- You have the consent of any living people identifiable in Your Content
4. Acceptable use
You may not:
- Create memorial pages for living persons or fictional persons without disclosure
- Use the service to defame, harass, or harm any person
- Upload illegal content, malware, or content that violates third-party rights
- Resell, scrape, or systematically copy content from the service
- Attempt to compromise the security of the service
We reserve the right to remove any memorial page that violates these Terms.
5. Payment
The current price is $49 USD per memorial page, payable in full at the time of creation. Payments are processed by Stripe. See our Refund Policy for refund terms.
6. The 100-year commitment
We commit to hosting your memorial page for 100 years from the date of generation. This commitment is funded by your one-time payment.
In the unlikely event Cherished ceases operations before 100 years have elapsed, we will make reasonable efforts to either transfer pages to a successor service or provide you with an export of Your Content. This is a commercially reasonable best-effort commitment and not a guarantee against business failure, force majeure, or events outside our control.
7. Intellectual property
All content on Cherished — including its design, code, and templates — is protected by intellectual property laws. You may not copy or reuse these without written permission.
8. Disclaimers
The service is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or available in all geographies. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
9. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms. Termination does not refund payments except as provided in our Refund Policy.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the service after changes constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
